Social media parameters in prenups

If you are involved in a serious relationship in Tennessee and have been discussing formalizing your commitment by getting married, now is the time to also discuss creating a prenuptial agreement with your partner. Marriage is as much a business and financial arrangement as it is a personal and emotional one which makes prenups important for people who want to address all sides of this relationship.

Today's prenuptial agreements have evolved from what they were originally known for and offer protections beyond concrete financial assets or physical belongings. As explained by AdWeek, one of the newer trends in modern prenups is the inclusion of what is referred to as the social media clause. Simply put, these clauses are a way of providing boundaries on the behaviors of each spouse online should the couple separate or get divorced.

Reputations can be damaged after just a few mouse clicks and keyboard strokes and for some people this can result in financial and professional downfalls as well as sheer embarrassment. To that end, there may be financial penalties assessed on the spouse who breaks the contract and posts something that they were not allowed to post about their former partner. These fines vary but can be as high as $50,000.

If you would like to learn more about social media clauses and other types of parameters that couples can set for themselves and each other in a prenuptial agreement, please feel free to visit the marital contract page of our Tennessee family law and divorce website.
